These Terms of Service govern your use of the website at techbomby.com (the "Site"). They do not govern any managed technology service relationship — that is covered by a separate Master Service Agreement ("MSA") that we send before you become a paying customer.
Who we are
Tech Baker LLC is a Florida limited liability company doing business as TechBomby, based in Winter Haven, Florida. "We," "us," "our," and "TechBomby" in these terms refer to Tech Baker LLC.
Use of the site
- You may use the site for lawful purposes only.
- You agree not to interfere with the site, attempt unauthorized access, probe for vulnerabilities, or use automated tools to overload it.
- You agree not to use the site to harass, defraud, or harm others.
- You agree not to scrape, copy, or republish substantial portions of the site without permission.
- You agree to provide accurate information when filling out forms.
Account and contact information
Forms on the site (contact form, scheduling, guide download) collect contact information for the purpose of responding. We treat that information per our Privacy Policy.
Intellectual property
All content on this site — text, design, components, the TechBomby and Tech Baker LLC names, marks, and logo — is owned by Tech Baker LLC or our licensors. You may view and print copies for personal, non-commercial reference. You may not reproduce, distribute, modify, or create derivative works without our written permission.
The Household Tech Guide PDF is provided for individual personal use. You may share it with friends and family. You may not republish it as your own content or build a competing offering from it.
Third-party links and services
The site links to and embeds third-party services (Cal.com for scheduling, Stripe for billing, Mailgun for email, Cloudflare for infrastructure). Use of those services is governed by their own terms and privacy policies. We are not responsible for third-party content, availability, or behavior.
Disclaimers
The site and all content on it are provided "as is" and "as available." We make no warranties about completeness, accuracy, fitness for any particular purpose, or non-infringement, except as required by applicable law.
Pricing, plan features, and other information on the site may change. The version of the site at the time you book a consultation is the basis for our discussion, but the binding pricing and feature commitments are in the MSA you sign as a customer.
Limitation of liability
To the maximum extent permitted by law, Tech Baker LLC is not liable to you for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the site, even if we have been advised of the possibility of such damages.
Our total cumulative liability for any claim arising out of or related to your use of the site is limited to $100 or the amount you have paid us for managed services in the prior 12 months, whichever is greater.
Indemnification
You agree to defend and indemnify Tech Baker LLC and its officers, employees, and agents against any claim or demand made by a third party due to or arising out of your breach of these terms or your unlawful use of the site.
Governing law and disputes
These terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Any dispute arising under these terms shall be brought in the state or federal courts located in Polk County, Florida, and you consent to the jurisdiction of those courts.
Modifications
We may update these terms from time to time. The effective date at the top reflects the most recent change. Continued use of the site after a change constitutes acceptance of the updated terms.
Severability
If any portion of these terms is held unenforceable, the remainder of these terms remain in full force and effect.
